Owner Standards – Purpose and Contractual Application

The University of Minnesota Capital Project Management (CPM) Owner Standards establish baseline requirements, expectations, and guidance for the planning, design,
construction, and operation of University facilities and landscapes. Owner Standards apply to all University capital projects, regardless of project delivery method.


Owner Standards are incorporated into professional service agreements, including AIA B101-2017, pursuant to Section 2.2.1. Design professionals are required to review all applicable Owner Standards and to incorporate the applicable requirements into the Contract Documents in a manner appropriate to the project scope and delivery method.
 

Constructors, including Construction Manager as Constructor (CMaR), Design-Build (DB), and Lump Sum General Contractors (GC), are required to be familiar with, review, and comply with the Owner Standards as they apply to the Work and as reflected in the Contract Documents. Compliance with the Contract Documents includes compliance with Owner Standard requirements incorporated therein. 


Owner Standards include, without limitation, University program and space requirements; design reference criteria; Building Standards addressing systems, materials, components, and workmanship; and design, construction, and operational requirements published under the CPM Owner Standards resource.
 

Owner Standards supplement, but do not replace, applicable federal, state, and local laws, codes, and regulations governing public health, safety, and welfare. Where Owner Standards do not address a specific condition, system, or design decision, the design professional shall exercise professional judgment consistent with the applicable standard of care.


Applicability, interpretation, and enforcement of Owner Standards for a specific project shall be determined by the Owner’s Project Manager.


Contract Documents that do not reasonably incorporate applicable Owner Standards may be rejected and returned for revision. Owner Standards are intentionally evolutionary and may be updated from time to time. Alternative solutions that meet the intent of the Owner Standards and provide quality, cost, schedule, or operational benefit may be proposed, subject to Owner review and written approval.
